Privacy Policy
Last updated: 22 July 2026
1. Purpose and scope
South Australian Bird Company respects your privacy. This Privacy Policy explains how we collect, hold, use and disclose personal information when you visit our website, create an account, place an order, make an enquiry, subscribe to marketing, participate in a promotion, submit content or otherwise interact with us.
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles to the extent they apply to us, together with other applicable Australian privacy, consumer and electronic marketing laws.
2. Personal information we may collect
Depending on how you interact with us, we may collect:
identity and contact details, including your name, telephone number, billing and delivery address, and contact details submitted through the website;
account details, login credentials and account preferences;
order, transaction, payment confirmation, refund, delivery and purchase history information;
enquiries, complaints, product reviews, survey responses, photographs, videos and other content you provide;
marketing preferences and records of consent, subscription and unsubscribe requests;
permit, identification or transaction-record information reasonably required for a regulated live-bird transfer;
technical and usage information, such as IP address, browser, device identifiers, pages viewed, referring links, approximate location, cookie identifiers and interactions with emails or advertising; and
fraud-prevention, security and customer-service records.
We do not intentionally collect sensitive information unless it is reasonably necessary for a lawful purpose and you consent, or collection is otherwise permitted or required by law. Please do not submit unnecessary sensitive information through the website.
3. How we collect information
We may collect information directly from you when you use the website or communicate with us; automatically through cookies and similar technologies; and from service providers involved in payments, e-commerce, fraud prevention, analytics, advertising, order fulfilment and delivery. We may also receive information from a person authorised to act for you or from a lawful public or regulatory source.
Where practical, you may interact with us anonymously or using a pseudonym. This may not be possible where we need your identity to process an order, deliver goods, verify payment, handle a claim, comply with permit or record-keeping requirements, or provide a requested service.
4. Why we collect, use and disclose information
We may handle personal information to:
operate the website and provide requested products and services;
create and administer customer accounts;
process payments, orders, delivery, collection, returns, credits and refunds;
respond to enquiries, complaints and privacy requests;
verify identity, permits, eligibility or transaction details where legally or operationally required;
personalise and improve products, website functions, customer service and advertising;
send service messages about orders, accounts, safety notices, recalls or policy changes;
send marketing where we have consent or another lawful basis, and manage opt-outs;
detect, prevent and investigate fraud, misuse, security incidents and unlawful activity;
meet accounting, tax, consumer, wildlife, animal welfare, product-safety, legal and regulatory obligations; and
establish, exercise or defend legal claims and protect customers, animals, our business and other people.
We will not use or disclose personal information for an unrelated purpose unless you consent or the use or disclosure is otherwise permitted or required by law.
5. Service providers and other recipients
We may disclose relevant personal information to providers that help us operate, including website and e-commerce hosts, payment processors, financial institutions, fraud-prevention services, delivery carriers, fulfilment partners, IT and cloud providers, analytics providers, marketing platforms, professional advisers and customer-support providers.
We may also disclose information to regulators, law-enforcement bodies, courts, insurers, professional advisers or other parties where required or authorised by law, and in connection with a genuine business sale, restructure or transfer subject to appropriate confidentiality and legal requirements.
We do not sell personal information for money.
6. Payments
Payments are processed by third-party payment providers. Full payment-card details are generally collected and handled by those providers rather than stored by us. Their handling of information is also governed by their privacy notices and security practices.
7. Overseas disclosure and storage
Some service providers, including e-commerce, cloud, analytics, payment, support and marketing providers, may store or process information outside Australia. The countries involved may vary according to the provider’s systems and subcontractors. Where the Australian Privacy Principles apply, we will take reasonable steps required by law in relation to overseas disclosure.
8. Cookies, analytics and advertising
We use cookies, pixels and similar technologies to operate checkout and account functions, remember preferences, protect the website, measure traffic and performance, understand customer interactions and, where enabled, support advertising.
You can control many cookies through browser or device settings. Blocking essential cookies may prevent parts of the website or checkout from working. Where required, consent controls will be provided for non-essential technologies.
9. Direct marketing
We may send commercial electronic messages only where we have consent or another basis permitted by the Spam Act 2003 (Cth). Marketing messages will identify the sender and provide a functional unsubscribe method. You may also withdraw marketing consent through /pages/contact.
We will action an unsubscribe request within the period required by law. Opting out of marketing does not prevent necessary service communications concerning an order, account, safety issue or legal obligation.
10. Security
We take reasonable technical and organisational steps to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure. These steps may include access controls, secure platforms, payment-tokenisation, monitoring, backups and staff or contractor confidentiality controls.
No internet transmission or storage system can be guaranteed completely secure. You are responsible for using a strong password, protecting account credentials and notifying us through /pages/contact if you suspect unauthorised account activity.
11. Data breaches
We will assess suspected data breaches and, where the Notifiable Data Breaches scheme or another applicable law requires it, notify affected individuals and the Office of the Australian Information Commissioner.
12. Retention and deletion
We retain personal information only for as long as reasonably needed for the purposes described in this Policy and to satisfy legal, accounting, tax, consumer, permit, animal-transfer, fraud-prevention and dispute-resolution requirements. When information is no longer required, we take reasonable steps to destroy or de-identify it, unless the law requires or permits continued retention.
13. Access and correction
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Submit the request through /pages/contact. We may need to verify your identity before responding.
We will respond within a reasonable period. If an applicable law permits us to refuse access or correction, we will provide reasons and available complaint options unless it would be unlawful to do so.
14. Privacy complaints
Submit a privacy concern or complaint through /pages/contact and include enough detail for us to investigate. We will acknowledge and investigate the matter within a reasonable period.
If you are not satisfied with our response and the Privacy Act applies, you may be entitled to complain to the Office of the Australian Information Commissioner. You can obtain current details from the OAIC website.
15. Children
The online store is intended for adults. We do not knowingly invite children to create accounts or purchase products. A parent or guardian who believes a child has submitted personal information without appropriate authority should notify us through /pages/contact.
16. Third-party links
Our website may link to independent websites or social platforms. We do not control their privacy practices. Review their privacy information before providing personal information to them.
17. Changes to this Policy
We may update this Policy to reflect changes in law, technology, providers or our operations. The current version and effective date will be published on the website. We will take additional notification steps where required by law.
18. Contact
For privacy questions, access or correction requests, consent withdrawals or complaints, use our Contact page at /pages/contact.
